Currently there is a new kind of identity theft going around that can and will land you in jail, cost you money to bond out, an appearance in court, and more serious consequences to innocent citizens of the city of Arlington due to a loophole in the system.

The scenario is simple; the traffic officer pulls over a suspect for a traffic violation. The suspect claims to have no identity on or about their person. Police officer requires there full name and D.O.B. to issue the citation. Then the suspect is free to go if no warrants were issued under the given name.

The problem occurs when the suspect gives the name and D.O.B. of another and validates this with the D.O.B. This information is easily available to everybody and can be gained through casual conversation. When this occurs they call the offense FAIL TO ID FUGITIVE.

The solution to this problem and the purpose of this petition is to make the arrest when no identification (i.e. valid driver’s license) can be displayed. The suspect then has no ability to get away with this loophole.

Our plan of action is two fold:

A. Direct advertising through new papers, television, mail outs, city council meetings, social events, word of mouth to the citizens of the DFW area who have fallen victim to this loophole and have been proven innocent in the city of Arlington for this in hopes to organize a class action lawsuit against the Arlington Police Department.
B. Petition to amend the law that requires a valid driver’s license to avoid arrest.

We have sent this issue to city mayor and chief of police on November 3rd 2006. They have chosen to not respond. Feel free to contact them yourselves at the following:
